The importance of Charging in Plea Bargain

Abstract

This work analyzes the effects of formulating charges in a possible plea bargain.  The charges imputation to certain people is an act that demands legal requirements.  The shortcomings of imputations have a possible impact on the plea bargain, since it is the foundation through which the legal and factual bases laid out.  In this sense, if the act of imputing charge with deficiencies is carried out, can the judge dismiss the imputation of charges?  In that sense, this is a descriptive essay made with an methodology that allows us to study the situation, based on bibliographic review that contain doctrine, legislation and judicial precedents; all this information were interpreted and analyzed in order to reach the corresponding conclusions.
